I was wondering if someone that you're dueling gets banned, are you allowed to take the kill?

If it was death enabled and they've gone past the 7 day rule, you've given them notice and received no response, enjoy your free kill good sir.

From what I'm reading you didn't really get to any fighting at all, no moves to attack, defend, pretty much nothing. So I'd say no, but Logan might be right about the seven day thing, not sure it'd really count as an actual kill in such a case though, as opposed to basically killing an NPC.

From what i know of the rules, the rule is that "last hit connects" if they don't post, so if there was no fighting or "last hit" then i don't believe you get the kill.

I've also seen people use the "free turn" rule as well, so theoretically he could just walk up and kill him outright.
